*** Yes, the Ontario Court of Appeal ruled that warrantless searches of electronic devices at Canadian borders are unconstitutional. The ruling was made in the case *R. v. Pike* and is based on the finding that the searches violate Section 8 of the Canadian Charter of Rights and Freedoms. Section 8 protects the right to be free from unreasonable search and seizure. The ruling was based on the Customs Act's subsection 99(1)(a), which allows border officers to search electronic devices without any reasonable suspicion or basis. The ruling could potentially change how digital devices are searched at Canadian borders. However, it does not automatically acquit those charged with serious crimes discovered during these searches.
